Terms of Service

These Terms of Service ("Terms") govern access to and use of frenzy.run (the "Service"), including the public leaderboard, submission and attack flows, and related features. By using the Service, submitting an entry, or completing a payment, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service and do not pay for an attack. Before checkout you must confirm, by checking a box, that you have read and agree to these Terms and that you want your attack carried out immediately (see §5.2).

Operator and contact

The Service is operated by Aevonix B.V. ("we", "us", "our"), a company registered in the Netherlands under KVK number 42123774, VAT number NL869834216B01, registered address Heresstraat 1, 9665 NV Oude Pekela, the Netherlands. The Service is provided from https://frenzy.run.

Frenzy's operator has entries on this board, marked operator. They pay the same prices and take the same hits as everyone else.

These Terms work together with the public Rules. If the Rules and these Terms conflict, these Terms control.

1. What Frenzy is

Frenzy is entertainment, not an endorsement — every listing is user-submitted, and appearance on the board is not our opinion of a product. An "attack" changes only an entry's rank on Frenzy's public leaderboard; it has no effect on the target's actual site, business, or reputation outside of this game, and it buys no traffic, clicks, customers, revenue, or any particular business outcome for the buyer or the target. Attacks are irreversible. Someone else can always outrank you later. We may change, pause, or discontinue features, including categories, tiers, and how many spots an attack moves.

3.1 Accounts are passwordless: we email you a single-use login link. There is no password to create or lose.

3.2 Submitting an entry is free. An entry only goes live once ownership of the listed identity is verified: either your account email's domain matches the entry's domain, or — for an account created by logging in with X — the entry is listed under the X account you authenticated with. Either way, this stops anyone from listing or attacking as a site or account they don't control. You may only submit a domain or account you own or are authorized to represent, and the information you submit must be accurate. Logging in with X does not require a verified email; we may email you at an address you separately provide, but it is not checked against any account you hold.

3.3 You may not attack your own entry, you may not attack using an entry you do not own, and you may not attack an entry belonging to your own account.

3.4 You can delete an entry, or your whole account, at any time from your account page. Deleting takes the entry off the board and erases your account data — but it does not erase the record of attacks you bought or attacks bought against you. Someone paid for each of those records; they stay public, attributed to the entry name and domain as they were at the time of the attack, after either side is deleted. Your email address was never part of that record. See §6 of the Privacy Policy for exactly what deletion does and does not reach.

4.1 Prices are shown in US dollars and are inclusive of Dutch VAT at our own applicable rate. The listed price is the total you pay — there is no separate tax line added at checkout, and no billing address is collected for tax-calculation purposes.

4.2 Payments are processed by Mollie. We never see or store your card number. Mollie's own terms and privacy notice also apply to the payment itself.

4.3 An attack always makes the target fall the tier's number of spots, clamped at last place — a target near the bottom falls only as far as the bottom. The attacking entry rises only if the target started strictly above it, and then by the same number of spots, capped at the target's old position: it may land on the position the target just left, never past it, and never above #1. An attacker further from the target than the tier's number of spots closes part of the gap and no more. Attacking a target that is already below you, or level with you, is pure sabotage — they still fall, you do not rise. Both outcomes are the purchase you're making; there is no guaranteed rank change for the attacker. Rank is assigned when payment is confirmed, at whatever position the attack then produces, and the board can move between the moment you open checkout and the moment your payment clears.

4.3a If the entry you attack has a shield, it falls fewer spots than the tier's headline number. A shield absorbs at most three quarters of a single attack, so part of every attack always lands and the target always falls at least one spot — but a Demolitionist attack on a well-shielded entry may move them five spots rather than twenty. How far the attack reaches also depends on how close you are to your target: an attack from directly below them does its full damage, and every position of distance between you takes one point off it. Before you pay, the attack window shows you the exact numbers for that specific target — how much their shield absorbs, and how many spots they will actually fall. That figure, not the tier's headline number, is what you are buying.

4.4 We may change prices. Changes only apply to purchases made after the change.

4.5 We will not sell you an attack that moves nobody. If the entry you picked is already in last place, so that nobody would fall and you would not rise either, checkout is refused before you pay. In the rare case where the board shifts between checkout and payment so that the attack lands with no effect at all, we cancel the attack and refund that payment in full, automatically, without you having to ask (§6.1).

4.6 Shield charges. You can buy shield charges for an entry you own. A charge is spent when it absorbs damage from an attack; a shield never stops an attack completely, and an entry with no charges left takes attacks at full strength. Charges are sold at a flat price per charge, in fixed sizes, and they never expire — unspent charges stay on your entry until an attack burns them. There is no limit on how many you may hold. Charges are tied to the one entry you bought them for: they cannot be moved to another entry, sold, or transferred, they have no cash value, and they are not exchangeable for money. If you delete your entry, or it is removed for breach of these Terms, any unspent charges on it are destroyed and are not refunded — the shield exists to protect that entry's position on the board, and there is no position left to protect. If a shield payment is refunded or charged back, we remove the charges it bought that you have not already spent.

5. Your 14-day right of withdrawal — and its waiver

5.1 If you are a consumer in the EU, you normally have a 14-day right to withdraw from a purchase of digital content or an on-demand service, without giving a reason.

5.2 An attack is delivered and carried out immediately and irreversibly once payment is confirmed. At checkout you are asked to expressly confirm that you want your attack to happen right away and that you understand you lose your right of withdrawal once it starts, before you can pay. This is the waiver that Article 16(m) of the Consumer Rights Directive (and its Dutch implementation) allows us to rely on. Where a mandatory consumer right cannot be waived, we honor it.

5.3 Submitting an entry is free and not a paid purchase, so no withdrawal right applies to it.

5.4 Shield charges are added to your entry immediately once payment is confirmed, and can be spent by somebody else's attack from that moment. You are asked to confirm the same waiver as in §5.2 before you can pay for them.

6. No refunds

6.1 Because attacks are delivered immediately and irreversibly (§5.2), all payments are final and non-refundable. Being outranked later, downtime, disliking a category, or a later removal of your entry for breach of these Terms does not create a refund. There are three exceptions. First, where mandatory law requires otherwise. Second, where we determine a payment was processed in error. Third — and this one is automatic — where an attack was charged but landed with no effect at all: nobody fell and you did not rise (§4.5). We refund that in full ourselves, whether or not you contact us, because it is a payment for a service that was never delivered. 6.2 A chargeback, payment dispute, or reversed payment without a legally required basis is a breach of these Terms. We may remove the entry involved and refuse future use of the Service.

9. Our right to remove entries

Every entry has a public Report button. A report goes into a moderation queue that we read by hand. You can report without an account, which also means we usually have no way to write back to you: we do not promise the reporter an individual reply or a fixed response time. What we do commit to is that every report is read, and that if a report leads us to hide or remove an entry, we email the account attached to that entry with the reason for the decision.

We may refuse, hide, or permanently remove any entry — with or without a report, and with or without notice — including where we believe these Terms, the Rules, or the law may have been broken, where a rights holder complains, or where we think the entry creates legal, security, or reputational risk. Removal does not entitle you to a refund. Removing or deleting an entry does not delete the public record of the attacks it bought or received (§3.4).

10. Fair use and third-party content

To run the board we fetch and display publicly available information about the sites you list: names, taglines, logos, favicons, and Open Graph images. We use that material only to identify the listed site on Frenzy, to show visitors where an entry leads, and to operate and moderate the Service. We do not use it as our own brand, and we do not suggest sponsorship or endorsement by the site's owner unless the submitter is that owner.

Where United States law applies, that display is intended as nominative fair use of trademarks and fair use of copyrighted material: we use only what is needed to identify the destination. Where Dutch or EU law applies, we use third-party names and marks solely to identify the site being listed, which is not an affiliation with or endorsement by the rights holder.

Frenzy, our wordmark, and the look of the Service are ours. You may not copy the Service or scrape the board for a competing product. Mollie and other third-party names remain their owners' property.

Some boards carry paid sponsor placements. A sponsor slot is advertising: it is bought, it is labelled “Sponsored” where it appears, and it is not an endorsement, a review, or a ranking signal. Buying a slot does not move any entry on the board, does not affect any attack, and does not buy a followed link — sponsor links, like the board's own outbound links, do not pass search-engine credit. We are not responsible for a sponsor's site, offer, or conduct, and we may refuse or remove any placement.

11. License you grant us

You grant us a worldwide, non-exclusive, royalty-free license to host, cache, and publicly display your entry and the public metadata we fetch for it, for as long as the entry stays on the board or in attack history. If you want an entry taken down, email hello@frenzy.run. Takedown does not undo a completed payment or reverse a board move that already happened.

12. Complaints and rights notices

If you believe an entry infringes your copyright, trademark, or other rights, or that a listed site is unlawful, email hello@frenzy.run with: (1) your name and contact details; (2) the entry's URL on frenzy.run; (3) the destination URL; (4) a description of the problem; and (5) a statement that the notice is accurate and that you are the rights holder or authorized to act. We may remove or restrict the entry while we review the notice. Repeat or abusive notices may be ignored.

13. No endorsement, no earnings claims

We do not verify that listed sites, their claims, or their products are legitimate. Click counts and "attacked X times" badges describe what our systems recorded, not a promise that you will get any particular outcome. Links from the Service leave frenzy.run; those destinations have their own terms and practices, and we are not responsible for them.

14. Availability

We aim for high availability but do not guarantee uninterrupted access. We are not liable for outages caused by force majeure or failures at third-party providers (hosting or payment) outside our reasonable control.

15. Disclaimers

To the fullest extent permitted by law, we provide the Service as-is and disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that entries, images, ranks, or click counts are accurate or complete.

16. Liability

16.1 We do not limit liability that applicable law says we cannot limit, including liability for intent, gross negligence, or death or personal injury caused by our fault. Subject to that:

17. Indemnity

You will defend, indemnify, and hold harmless Rogier Bruggeman and anyone working on the Service from claims, damages, losses, and reasonable legal fees arising out of your entry, your destination site, your payment or chargeback, your breach of these Terms, or your infringement of someone else's rights. We may take over the defense of a claim; you will cooperate.

18. Governing law and disputes

18.1 These Terms are governed by Dutch law. If you are a consumer habitually resident in another EU member state, the mandatory consumer-protection provisions of that country's law still apply to you regardless of this choice of law (Rome I Regulation, art. 6).

18.2 Disputes we cannot resolve amicably may be submitted to the competent Dutch court. If you are not a consumer, the courts at our place of residence in the Netherlands have exclusive jurisdiction, to the extent permitted. If you are a consumer, you may also bring a claim before the courts of your own country of residence.

19. Changes to these Terms

We may update these Terms. If a change is material, we update the date at the top of this page and give at least 30 days' notice by email before it takes effect. Continued use after a change means you accept the new Terms. For a payment already completed, the Terms in effect at checkout still apply to that payment, except where a change is required by law or to address a security or legal risk.
